Terms and Conditions

Exclusive sale to individuals over 18 years of age. Spanish law prohibits the sale and supply of alcoholic beverages to minors under 18 years of age. By placing an order, you declare that you are over 18 years of age.

2. Purpose

These Terms and Conditions govern the distance selling of wines produced by Bodegas y Viñedos Mainetes through this website, pursuant to Royal Legislative Decree 1/2007 (TRLGDCU) and Law 7/1996 on Retail Trade Regulation.

Placing an order implies express and full acceptance of these Terms, which must be confirmed by checking the corresponding box before completing the payment.

3. Legal Age Requirement

The sale of alcoholic beverages is strictly reserved for individuals aged 18 and older.

By placing an order, the customer declares under their own responsibility that they are of legal age and have the legal capacity to enter into a contract.
Delivery will only be made to a person of legal age, who must verify their age with an official ID document if requested by the courier.
If delivery cannot be completed due to failure to prove legal age, the order will be returned, and shipping and return costs will be charged to the customer and deducted from the refunded amount.

4. Products and Prices

All prices are expressed in euros and include applicable VAT. Shipping costs are calculated and displayed separately prior to completing the purchase.

Applicable prices are those displayed on the website at the time of placing the order. The winery reserves the right to modify prices at any time, without affecting orders already confirmed.

In the event of an obvious typographical error in a price, the winery will inform the customer as soon as possible, and the customer may either reconfirm the order at the correct price or cancel it with a full refund.

5. Availability

Our wines are produced in limited quantities. If, after confirming an order, a product becomes unavailable, we will inform you within a maximum period of 48 business hours. You may choose to substitute it with a wine of equivalent value, wait for restocking, or cancel that part of the order with a refund of the corresponding amount.

6. Purchase Process

Selection of wines and quantities.
Input of billing and shipping details.
Review of the order summary displaying product breakdown, shipping costs, and total amount.
Acceptance of Terms and Conditions and Privacy Policy.
Payment.
Receipt of order confirmation email containing the order number.

The contract is concluded when the customer receives the order confirmation email. We recommend retaining this email.

The contract language is Spanish.

7. Payment Methods

Payment is processed via credit or debit card through the secure Stripe payment gateway. Card details are transmitted encrypted directly to the payment provider; the winery never stores full card details at any time.

The charge is applied upon order confirmation. If the payment is rejected, the order will be automatically canceled.

8. Shipping

8.1. Delivery Area

We ship to peninsular Spain.

8.2. Shipping Costs

Free shipping on orders equal to or exceeding €90 (product amount, VAT included, prior to shipping fees).
Orders under €90: inquire by email.

8.3. Delivery Times

Estimated delivery time is 15 to 20 business days from order confirmation for shipments to peninsular Spain.

Orders placed on weekends or public holidays are processed on the following business day. During high-volume periods (Christmas, harvest season), delivery times may be extended and will be announced on the website.

In accordance with Article 109 of TRLGDCU, the maximum delivery time shall not exceed 30 calendar days from order formalization.

8.4. Courier and Tracking

Shipment is handled by specialized courier companies utilizing protective packaging designed specifically for wine bottles. Once dispatched, the customer will receive a tracking number.

9. Order Receipt and Transport Issues

We advise inspecting the parcel upon delivery. If the packaging shows signs of impact, moisture, or breakage:

Note it down on the courier’s delivery slip before signing.
Notify hotel@enoturismomainetes.com within a maximum period of 24 hours, attaching photographs of the packaging and contents.

We will manage the incident with the courier and proceed to replace affected bottles or refund their value at no cost to the customer.

10. Right of Withdrawal

Customers acting as consumers have 14 calendar days from receipt of the order to withdraw from the contract without giving any reason and without penalty, in accordance with Articles 102 et seq. of TRLGDCU.

10.1. How to Exercise It

By unequivocally communicating your decision before the deadline expires, via:

Email to hotel@enoturismomainetes.com indicating the order number, or
The withdrawal form provided at the end of this document.

10.2. Product Return

The customer must return the wines within a maximum period of 14 calendar days from the withdrawal notification, in their original packaging, unopened, with intact seals and labels, and in perfect condition.

The direct cost of returning the goods shall be borne by the customer.

Returns of opened, partially consumed, or damaged bottles resulting from improper handling or stored under conditions that alter the product will not be accepted. In such cases, the customer will be liable for any diminished value of the goods.

10.3. Refunds

We will refund the product price and standard delivery costs within a maximum of 14 calendar days from the date we are informed of your decision to withdraw, using the same payment method used for the initial transaction. We may withhold the refund until we have received the goods back or until proof of return has been supplied.

11. Warranty and Defective Products

If a wine presents a lack of conformity, the customer holds the rights recognized under TRLGDCU. Please report it to hotel@enoturismomainetes.com describing the issue and, if possible, attaching photographs, retaining the bottle and its contents for evaluation.

Wine is a living product: natural variations in color, sediment, or bottle evolution do not constitute defects. Subsequent storage after delivery is the customer’s responsibility; improper storage (heat, direct light, improper position) may alter the product.

12. Invoicing

The customer will receive an electronic invoice at the email address provided. If an invoice with company or freelancer tax details is required, it must be specified at the time of ordering.

13. Responsible Consumption

At Bodegas y Viñedos Mainetes, we promote the moderate and responsible consumption of wine. Alcohol consumption is incompatible with driving and is strongly advised against during pregnancy, breastfeeding, and for minors.

14. Liability

The winery shall not be liable for damage arising from improper use or consumption of the product, nor for non-performance caused by force majeure or third-party acts beyond its control.

15. Complaints and Dispute Resolution

Complaints may be submitted to hotel@enoturismomainetes.com. We undertake to respond within a maximum period of one month.

Customers may contact the consumer protection services of their Autonomous Community.

Data Protection

Personal data provided will be processed to manage order fulfillment, shipping, invoicing, and customer care in accordance with GDPR and LOPDGDD. You can review complete details in our Privacy Policy.

17. Applicable Law and Jurisdiction

These Terms are governed by Spanish law. For the resolution of any dispute, jurisdiction shall belong to the courts and tribunals determined by applicable consumer protection laws, which in the case of consumers corresponds to the consumer’s domicile.
