Purpose<\/b><\/li><\/ul><p><span style=\"font-weight: 400;\">These Terms and Conditions govern the distance selling of wines produced by Bodegas y Vi\u00f1edos Mainetes through this website, pursuant to Royal Legislative Decree 1\/2007 (TRLGDCU) and Law 7\/1996 on Retail Trade Regulation.<\/span><\/p><p><span style=\"font-weight: 400;\">Placing an order implies express and full acceptance of these Terms, which must be confirmed by checking the corresponding box before completing the payment.<\/span><\/p><p><b>3. Legal Age Requirement<\/b><\/p><p><span style=\"font-weight: 400;\">The sale of alcoholic beverages is strictly reserved for individuals aged 18 and older.<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">By placing an order, the customer declares under their own responsibility that they are of legal age and have the legal capacity to enter into a contract.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>Delivery will only be made to a person of legal age<\/b><span style=\"font-weight: 400;\">, who must verify their age with an official ID document if requested by the courier.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">If delivery cannot be completed due to failure to prove legal age, the order will be returned, and shipping and return costs will be charged to the customer and deducted from the refunded amount.<\/span><\/li><\/ul><p><b>4. If, after confirming an order, a product becomes unavailable, we will inform you within a maximum period of 48 business hours. You may choose to substitute it with a wine of equivalent value, wait for restocking, or cancel that part of the order with a refund of the corresponding amount.<\/span><\/p><p><b>6. Card details are transmitted encrypted directly to the payment provider; the winery never stores full card details at any time.<\/span><\/p><p><span style=\"font-weight: 400;\">The charge is applied upon order confirmation. If the payment is rejected, the order will be automatically canceled.<\/span><\/p><p><b>8. Shipping<\/b><\/p><p><b>8.1. Delivery Area<\/b><\/p><p><span style=\"font-weight: 400;\">We ship to <\/span><b>peninsular Spain<\/b><span style=\"font-weight: 400;\">.<\/span><\/p><p><b>8.2. Delivery Times<\/b><\/p><p><span style=\"font-weight: 400;\">Estimated delivery time is <\/span><b>15 to 20 business days<\/b><span style=\"font-weight: 400;\"> from order confirmation for shipments to peninsular Spain.<\/span><\/p><p><span style=\"font-weight: 400;\">Orders placed on weekends or public holidays are processed on the following business day. During high-volume periods (Christmas, harvest season), delivery times may be extended and will be announced on the website.<\/span><\/p><p><span style=\"font-weight: 400;\">In accordance with Article 109 of TRLGDCU, the maximum delivery time shall not exceed 30 calendar days from order formalization.<\/span><\/p><p><b>8.4. Courier and Tracking<\/b><\/p><p><span style=\"font-weight: 400;\">Shipment is handled by specialized courier companies utilizing protective packaging designed specifically for wine bottles. Once dispatched, the customer will receive a tracking number.<\/span><\/p><p><b>9. Order Receipt and Transport Issues<\/b><\/p><p><span style=\"font-weight: 400;\">We advise <\/span><b>inspecting the parcel upon delivery<\/b><span style=\"font-weight: 400;\">. If the packaging shows signs of impact, moisture, or breakage:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Note it down on the courier&#8217;s delivery slip before signing.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Notify hotel@enoturismomainetes.com within a maximum period of <\/span><b>24 hours<\/b><span style=\"font-weight: 400;\">, attaching photographs of the packaging and contents.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">We will manage the incident with the courier and proceed to replace affected bottles or refund their value at no cost to the customer.<\/span><\/p><p><b>10. Right of Withdrawal<\/b><\/p><p><span style=\"font-weight: 400;\">Customers acting as <\/span><b>consumers<\/b><span style=\"font-weight: 400;\"> have <\/span><b>14 calendar days<\/b><span style=\"font-weight: 400;\"> from receipt of the order to withdraw from the contract without giving any reason and without penalty, in accordance with Articles 102 et seq. of TRLGDCU.<\/span><\/p><p><b>10.1. How to Exercise It<\/b><\/p><p><span style=\"font-weight: 400;\">By unequivocally communicating your decision before the deadline expires, via:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Email to hotel@enoturismomainetes.com indicating the order number, or<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The withdrawal form provided at the end of this document.<\/span><\/li><\/ul><p><b>10.2. Product Return<\/b><\/p><p><span style=\"font-weight: 400;\">The customer must return the wines within a maximum period of 14 calendar days from the withdrawal notification, <\/span><b>in their original packaging, unopened, with intact seals and labels, and in perfect condition<\/b><span style=\"font-weight: 400;\">.<\/span><\/p><p><b>The direct cost of returning the goods shall be borne by the customer.<\/b><\/p><p><span style=\"font-weight: 400;\">Returns of opened, partially consumed, or damaged bottles resulting from improper handling or stored under conditions that alter the product will not be accepted. In such cases, the customer will be liable for any diminished value of the goods.<\/span><\/p><p><b>10.3. Refunds<\/b><\/p><p><span style=\"font-weight: 400;\">We will refund the product price and standard delivery costs within a maximum of 14 calendar days from the date we are informed of your decision to withdraw, using the same payment method used for the initial transaction. We may withhold the refund until we have received the goods back or until proof of return has been supplied.<\/span><\/p><p><b>11. Warranty and Defective Products<\/b><\/p><p><span style=\"font-weight: 400;\">If a wine presents a lack of conformity, the customer holds the rights recognized under TRLGDCU. Please report it to hotel@enoturismomainetes.com describing the issue and, if possible, attaching photographs, retaining the bottle and its contents for evaluation.<\/span><\/p><p><span style=\"font-weight: 400;\">Wine is a living product: natural variations in color, sediment, or bottle evolution do not constitute defects. Subsequent storage after delivery is the customer&#8217;s responsibility; improper storage (heat, direct light, improper position) may alter the product.<\/span><\/p><p><b>12. Invoicing<\/b><\/p><p><span style=\"font-weight: 400;\">The customer will receive an electronic invoice at the email address provided. If an invoice with company or freelancer tax details is required, it must be specified at the time of ordering.<\/span><\/p><p><b>13. Responsible Consumption<\/b><\/p><p><span style=\"font-weight: 400;\">At Bodegas y Vi\u00f1edos Mainetes, we promote the <\/span><b>moderate and responsible consumption<\/b><span style=\"font-weight: 400;\"> of wine. Alcohol consumption is incompatible with driving and is strongly advised against during pregnancy, breastfeeding, and for minors.<\/span><\/p><p><b>14. Liability<\/b><\/p><p><span style=\"font-weight: 400;\">The winery shall not be liable for damage arising from improper use or consumption of the product, nor for non-performance caused by force majeure or third-party acts beyond its control.<\/span><\/p><p><b>15. Complaints and Dispute Resolution<\/b><\/p><p><span style=\"font-weight: 400;\">Complaints may be submitted to hotel@enoturismomainetes.com. We undertake to respond within a maximum period of one month.<\/span><\/p><p><span style=\"font-weight: 400;\">Customers may contact the consumer protection services of their Autonomous Community.<\/span><\/p><ol start=\"16\"><li><b> Data Protection<\/b><\/li><\/ol><p><span style=\"font-weight: 400;\">Personal data provided will be processed to manage order fulfillment, shipping, invoicing, and customer care in accordance with GDPR and LOPDGDD.
